Changes in Section 8 & 13 Notices

In addition to the new prescribed Section 21 Notice, landlords should also be aware of changes in Section 8 and 13 Notices.

Section 8 Notice

A Section 8 Notice can be served when a tenant renting under an AST (Assured Shorthold Tenancy) is in rent arrears and the landlord wants vacant possession.

If there are no rent arrears, there are other grounds on which the landlord can serve the notice. These include: if the property is being repossessed, if the tenant is causing a nuisance to neighbours or if the using the property for illegal activity (and have been convicted for this by a court), the tenant caused damage to the property either by neglect, or from another party that was staying with the tenant or visiting, the tenant gave incorrect information when (s)he entered into the agreement of the tenancy or the tenant has breached other clauses in the tenancy agreement.

Section 13 Notice

Section 13(2) of the Housing Act 1988 states that the landlord with a tenant on a periodic AST must issue the tenant with a Section 13 Notice if the increase in rent was not stated in the tenancy agreement.

Changes in Section 8 and 13 Notices

The section 8 notice and guidance notes to tenants that form part of the notice have been updated to accommodate the new grounds of possession. These include ground 7A (which relates to anti-social behaviour) and ground 14ZA (which relates to an offence taking place at the scene of a riot).
